We are pleased that you are visiting the website of ER&GE GmbH. Protection of your private data is extremely important to us. With this data protection declaration we want to extensively inform you about the use of your data.

§ 1 Information about the collection of personal data

  1. This data protection declaration informs you about the nature, scope and purpose of the processing of personal data when using our website. Personal data is all data with regards to your person e.g. name, address, E-mail address, user behaviour. The term “user” includes all customers and visitors of our website.

§ 2 Your rights

  1. You have the following rights regarding the processing of your data
    1. Right of access, that means that you have the right to receive information from us regarding the processing of your personal data (Art. 15 of the General Data Protection Regulation (“GDPR”))
    2. Right to rectification, that means that you have the right to demand that we correct your personal data which are incorrect and/or incomplete (Art. 16 GDPR)
    3. Right to erasure, that means that you have the right to demand the deletion of your data (Art. 17 GDPR) as long as further processing is not necessary for
      • exercising the right of freedom of expression and information,
      • for compliance with a legal obligation,
      • for reasons of public interests,
      • for the establishment, exercise or defence of legal claims.
    4. Right to demand the restriction of the processing of your personal data (Art. 18 GDPR), so far as
      • you contest the accuracy of the data,
      • processing is unlawful, but you are against its deletion,
      • we do not need the data anymore, but you require it for the establishment, exercise or defence of legal claims or
      • you have objected the processing pursuant to Art. 21 GDPR.
    5. Right to receive the personal data concerning you in a structured, commonly used and machine-readable format and the right to transmit those data to another controller (right to data portability pursuant to Art. 20 GDPR).
  2. You have the right to object to the processing of personal data in accordance with the legal requirements at any time with effectiveness for the future. This objection can specifically concern the processing in regards to direct marketing. Objections are to be send to the address mentioned in § 8.
  3. Pursuant to Art. 21 GDPR you have the right to object, on grounds relating to your particular situation, at any time to the processing of your personal data, concerning you which is based on personal reasons mentioned in Art. 6 para. 1 sentence 1 lit. e) or f) GDPR.
  4. Without prejudice to any other administrative or other legal remedy you have the right to complain to a government supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement, if you consider that the processing of your personal data violates the General Data Protection Regulation (Art. 77 GDPR).

§ 3 Legal basis

We collect and process personal data on the following legal basis:

  1. Consent according to Art. 6 para. 1 s. 1 lit. a) GDPR. Consent means any voluntary expression of intent, in an informed and unequivocal manner, in the form of a statement or any other unambiguous confirmatory act that indicates that you consent to the processing of personal data concerning you.
  2. Necessity to fulfil the contract or carry out preparatory measures in accordance with Art. 6 para. 1 s. 1 lit. b) GDPR. That means the data is required so that we can fulfil the contractual obligations to you or we need the data to prepare a contract with you.
  3. Processing for the fulfilment of a legal obligation pursuant to Art. 6 para. 1 s. 1 lit. c) GDPR, that means that for example, a law or other regulation requires processing of the data.
  4. Processing for the purpose of legitimate interests in accordance with Art. 6 para. 1 s. 1 lit. f) GDPR. That means that processing is necessary for the purposes of legitimate interests by us or by a third party, except where our interests are overridden by your interests or fundamental rights and freedoms which require the protection of personal data.

§ 4 Collection of personal data when visiting our website, hosting services by a third party

  1. You can visit our website without disclosing us who you are. Whenever you visit our website we will only collect the personal data your browser transmits to our server (“access data”) as long as you do not register yourself or provide us with information otherwise. Access data generally includes your IP address, the country and the requesting provider.
  2. The processing of this information is solely for the purpose of ensuring trouble-free operation of our website and to improve our offer. This serves our legitimate interest in a concrete and correct presentation of our offer according to Art. 6 para. 1 s. 1 lit. f) GDPR. All access data will be deleted no later than 12 months after the end of your page search.

§ 5 Data collection and processing when establishing contact

  1. When you contact us (e.g. via our contact form or by e-mail, in writing or by telephone), the information voluntarily provided by you (your e-mail address, first and last name, address and your telephone and fax number) are only saved by us to process your request. Mandatory fields and mandatory information such as last name, first name and e-mail address are marked as such by means of a "*" using in the contact form "Quick contact". Depending on your request (e.g. questions about our products or orders), your contact details will be processed further. If necessary for the processing of your request, your contact data can be forwarded to third parties (e.g. partner companies).
  2. We use the data provided by you in accordance with Art. 6 para. 1 s. 1lit. f) GDPR for processing your request and for further communication with you. Herein lie the legitimate interests. If your contact aims to conclude a contract with us, the legal basis for the processing of your contact data is Art. 6 para. 1 s. 1 lit. b) GDPR.
  3. After processing your request and terminating further communication, your contact information will be deleted. The other applies if your contact is aimed at concluding a contract with us or you assert your data subject rights (such as information). For this purpose, the data will be saved until the contractual and / or legal obligations have been fulfilled and legal retention periods (currently 6 to 10 years) do not exclude a deletion.
  4. You have the right to object to the processing of your contact details, provided your particular situation gives you reasons to do so. If you wish to exercise your objection, please contact the contact address stated under § 8. If you object, the communication with you cannot be continued. The other applies if the storage of your contact data is necessary for the execution of the contract or fulfilment of the contract or the enforcement of your data subject rights.

§ 6 Transfer of data

  1. Within our company only those bodies gain access to your data they need to fulfil the purposes described in § 5. Our service providers can also access your data (e.g. data centres). Processing contracts (“Verträge zur Auftragsverarbeitung”) ensure the adherence to instruction, the data security and the trustworthy handling of your data by these service providers.
  2. For fulfilment of the contract pursuant to Art. 6 para. 1 s. 1 lit. b) GDPR we will transfer your data to the forwarding agent commissioned with delivery, insofar as this is necessary for the delivery of ordered goods. Depending on the terms of payment chosen in the contract, we will forward the payment data collected to the payment institution responsible for the payment and any payment service providers commissioned by us to process payments. Insofar as you have given us your express consent during or after your order, we will give forward your name, e-mail address and telephone number to the selected shipping service provider pursuant to Art. 6 para. 1 s.1 lit. a) GDPR so that they can contact you for the purpose of delivery coordination. The consent can at any time be revoked by you for the future, e.g. by sending a message to info@ergeplas.de.
  3. A data transfer to other recipients (e.g. advertising partners) does not take place.

§ 7 Third party services and content on our website

  1. We include external services or content on our website. If you use such a service or if third-party content is displayed to you, technically required communication data will be exchanged between you and the respective provider.
  2. In addition, it may be that contents of your data are processed by the provider of the respective services for own purposes. Since we have no influence on the data collected by third parties and their processing by them, we cannot provide any binding information for the purpose and scope of the processing of your data.
